24 Channel Community User Agreement

Website – a website located on the Internet at https://24tv.ua/.

Community – an interactive section of the Website that provides registered Users with the opportunity to set up personalized news feeds according to selected interests (topics), receive news selections (digests) for these interests at a chosen time in their personal account on the Website and/or to their email address, as well as to leave Comments on articles.

User – an individual who has reached the age of 21, has full civil legal capacity and has completed the registration procedure in the Community.

Account – the personal space of the User in the Community, access to which is carried out using unique identifiers (phone number or email address).

Personal Data – information or a set of information about the User provided by them during registration.

Comment – a text or other message created and posted by the User in a specially designated section under the materials of the Website (articles), intended to express their own opinion, reaction or participation in a discussion.

2.1. To gain access to the functionality of the Community, the User must complete the registration procedure.

2.2. During registration, the User provides the following information:

• Phone number OR Email address. One of these fields is mandatory at the choice of the User.
• Name. The field is mandatory when registering via phone number or email.
• Surname. Optional field.
• Date of birth, City of residence, Interests and preferred time for notifications. Optional fields.

2.3. The User bears full responsibility for the accuracy, relevance and completeness of the information provided during registration.

2.4. The User undertakes to keep their data for accessing the Account confidential.

2.5. When registering or logging in using a phone number, the User gives their unconditional consent to receive system messages (SMS/Viber) with a one-time access code (OTP) from the alphanumeric sender ID “24TV” to confirm their action. Such messages are an integral part of the registration/authorization process and ensuring the security of the Account.

3.1. Intellectual Property Rights to Comments

3.1.1. By posting a Comment on the Website, the User confirms that they are its author or have all the necessary rights for its publication.

3.1.2. The User grants the Administration a free, non-exclusive, worldwide, perpetual license to use (reproduce, publish, translate, distribute, publicly display, modify and create derivative works from) this Comment within the framework of the operation of the Website and other resources of the Administration.

3.2. Requirements for the Content of Comments

3.2.1. Users are prohibited from posting Comments that:

• Contain profanity, obscene words, swearing, vulgar and offensive expressions.
• Promote violence, cruelty, discrimination on racial, ethnic, religious, gender or other grounds.
• Contain calls for the overthrow of the constitutional order, violation of the territorial integrity of Ukraine or other illegal actions.
• Violate the honor, dignity, business reputation of third parties, their intellectual property rights.
• Contain spam, advertising, links to third-party resources unrelated to the topic of discussion (except in cases where this is expressly permitted by the Administration).
• Constitute defamation, insult, or contain elements of trolling or flooding.

3.3. The Process of Comment Moderation

3.3.1. Automatic moderation. All User Comments undergo automatic preliminary moderation. Comments that contain obscene words and profanity (the list of which is determined by the internal algorithms of the Administration) are removed systematically.

3.3.2. Manual moderation. The Administration reserves the right to conduct manual moderation of Comments. In particular, manual moderation is applied to Comments about which complaints have been received from other Users.

3.3.3. The right of the Administration to delete. The Administration has the unconditional right to delete, without warning, any Comment that, in its opinion, violates clause 3.2 of this Agreement, or if its content does not comply with generally accepted norms of ethics and morality, without explaining the reasons.

3.3.4. Responsibility. The User bears full responsibility for the content of the Comments posted by them in accordance with the current legislation of Ukraine. The Administration is not responsible for the content of Comments posted by Users.

4.1. By registering in the Community, the User gives the Administration their voluntary and unconditional consent to the collection and processing of their personal data in accordance with the Law of Ukraine “On the Protection of Personal Data”.

4.2. The Administration collects and processes the personal data of the User exclusively for the following purposes:

• Identification of the User in the Community.
• Ensuring the process of authorization and recovery of access to the Account. Access to the Account is carried out by sending a one-time password (OTP) in a message (SMS/Viber) to a phone number or a unique link to the email address of the User.
• Sending personalized content and digests. If the User has set up the receipt of news selections (digests), the Administration will send them to the specified email address according to the selected interests and time.
• Ensuring the functionality of commenting and moderation. For identifying the author of a Comment, as well as for applying the mechanisms of moderation and deletion of Comments in case of violation of the terms of the Agreement.
• Sending service (non-marketing) messages related to the operation of the Community. Such messages include:
  • System notifications for registration and authorization (for example, “24 Community: Your confirmation code: XXXXXX. Valid for 10 minutes.”).
  • Notifications about changes to this Agreement.
  • Other technical notifications related to the development of the Community functionality.

4.3. The Administration guarantees that the personal data of the User will not be used to send third-party marketing, advertising or any other commercial mailings without obtaining separate explicit consent from the User.

4.4. The personal data of the User is stored throughout the entire period of existence of their Account on the Website.

4.5. The Administration undertakes not to transfer the personal data of the User to third parties, except in cases expressly provided for by the current legislation of Ukraine.

4.5. We use “pixel” technology (web beacons) to analyze the effectiveness of our mailings. When images in an email are loaded, we receive information about the fact and time of opening, as well as technical data about the device (browser type, IP address, approximate geolocation). This data is used exclusively to improve the quality of content, is stored for 90 days, after which it is anonymized or deleted. You can avoid tracking by disabling the automatic loading of images in the settings of your email client, or completely unsubscribe from the mailing by clicking “Unsubscribe”.

5.1. The User has the right to:

• Access their personal data, change and clarify it in the Account settings.
• Delete their Account and all associated personal data. The User can do this themselves in their personal account by going to: “Settings” → “Account Management”. After deleting the Account, data recovery will be impossible.
• Contact the Administration with questions regarding the operation of the Community and the processing of their personal data.

5.2. The User undertakes to:

• Comply with the terms of this Agreement.
• Provide accurate information during registration and keep it up to date.
• Comply with the commenting rules established in Section 3 of this Agreement.
• Not use the Account in a way that may harm the normal operation of the Website.

5.3. The Administration has the right to:

• Make changes to this Agreement, notifying Users in advance by publishing a new edition on the Website and/or sending a service message.
• Restrict or block access to the Community (including suspending the right to comment) for Users who violate the terms of this Agreement.
• Carry out moderation, editing or deletion of User Comments in accordance with Section 3 of this Agreement.
• Send Users the messages specified in clause 4.2 of this Agreement.

5.4. The Administration undertakes to:

• Ensure the proper operation of the Community.
• Take the necessary organizational and technical measures to protect the personal data of Users from unauthorized access.
• Provide the User with the ability to manage their Account and personal data, including their deletion.

6.1. The User bears full responsibility for the accuracy of the data provided by them, for maintaining the confidentiality of their data for accessing the Account (one-time codes, access to phone and email), as well as for the content of the Comments posted by them.

6.2. Limitation of liability. The Administration is only a technical platform (information intermediary) for posting Comments and is not the author, distributor, editor or censor of the information posted by Users. The Administration bears no responsibility for the legality, accuracy, completeness or compliance with moral norms of the content of Comments. All claims regarding the content of Comments must be addressed to their authors.

6.3. The Administration provides the functionality of the Community on an “as is” basis and does not guarantee its uninterrupted operation or the absence of errors.

6.4. In the event of a violation by the User of the commenting rules established by Section 3, the Administration has the right to completely block the ability of the User to leave Comments without prior notice and without compensation for any damages.

7.1. This Agreement enters into force from the moment the User completes the registration procedure in the Community and is valid throughout the entire period of use of the Community.

7.2. All disputes and disagreements arising in connection with the implementation of this Agreement are resolved through negotiations. In case of failure to reach agreement, the dispute is resolved in court in accordance with the current legislation of Ukraine.
